Treasury Proposes the Operating Rules for a 2027 Institutional Home-Purchase Restriction

Treasury proposed regulations for Section 1001 of the 21st Century ROAD to Housing Act. Beginning January 7, 2027, the statute generally restricts a qualifying large institutional investor—defined in part by investment control over at least 350 single-family homes—from purchasing another single-family home unless an exception applies. Treasury’s proposal supplies standards and safe harbors for build-to-rent, renovate-to-rent, homeownership, passive-investor, debt-workout and related transactions; comments are due within 30 days of Federal Register publication. The law sets a future restriction and the notice proposes implementation rules. Neither record yet measures additional homes available to individual buyers, prices, rents, construction, rehabilitation or market liquidity.
